These Terms of Use (the "Terms") are a binding agreement between you and FlameAI. FlameAI is a trading name used by Mikhail Grechka, an Individual Entrepreneur registered in Georgia under identification number 322771292, with registered address at Village Varkhani, 7th Street N7, Adigeni District, Georgia ("FlameAI," "we," "us," or "our"). These Terms govern your use of the website flameai.studio and the FlameAI platform (the "Service"). By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and our Refund Policy. If you use the Service on behalf of a company, you confirm you are authorized to bind that company, and "you" includes it. If you do not agree, do not use the Service.
PLEASE NOTE: SECTION 11 LIMITS OUR LIABILITY, AND SECTION 5 EXPLAINS WHAT RIGHTS YOU RECEIVE IN AI-GENERATED CONTENT.
FlameAI lets you create marketing videos and related creative assets: you pick a template, upload an input (typically a product photo), and our platform generates the video using third-party artificial intelligence models. We may add, remove, or substitute the underlying AI models, templates, and features at any time to maintain or improve quality, cost, or availability. The specific model used for a given generation is not disclosed and is not part of what you purchase: you purchase access to the Service and its results.
We may modify or discontinue parts of the Service at any time. We will make reasonable efforts to notify you in advance of material changes that adversely affect paid subscriptions.
You must be at least 18 years old and able to enter a binding contract. You agree to provide accurate registration information, keep your credentials confidential, and notify us at support@flameai.studio of any unauthorized use. You are responsible for all activity under your account. One account per person or business; do not share or transfer accounts or evade usage limits with multiple accounts.
We offer a Free tier and paid subscriptions (currently "Plus" and "Pro"). Current prices and full plan details are listed at flameai.studio/pricing; the plan terms and price displayed at the time of your purchase govern that billing cycle. As of the date of these Terms:
Annual subscriptions are billed once per year at a discounted rate and credits are allocated monthly. All amounts are billed exactly as displayed at checkout.
Generations consume Flame Credits ("Credits"). The Credit cost of each generation is shown before you click Generate. Credits are a universal counter: access to features (such as 4K or Pro templates) is determined by your active plan, not by your Credit balance or where the Credits came from. Credits have no cash value, are non-transferable, and are not redeemable for cash.
There are three types of Credits:
When you generate, Credits are deducted in this order: first Subscription Credits, then Extra Credits (oldest pack first), then Free Credits. If a generation fails due to a technical error on our side or on the side of an AI provider, the Credits are automatically refunded to the same balance they were deducted from.
Extra Credit packs can be purchased only while you have an active Plus or Pro subscription. Monthly purchase limits apply (currently 2,500 Extra Credits per calendar month on Plus and 5,000 on Pro; limits reset on the 1st of each month). Extra Credits remaining after your subscription ends stay on your balance until their individual expiry dates and can be used on Free templates; features locked to a higher plan remain locked until you resubscribe.
Free-tier generations carry a visible FlameAI watermark and may be used for evaluation only; you may not remove, crop, or obscure the watermark or use watermarked output in advertising or other public distribution. The watermark is permanently removed from all new generations after your first payment of any kind.
Your subscription renews automatically (monthly or annually, as purchased) and the payment method on file is charged at the start of each new period, unless you cancel before the end of the current period. You can cancel anytime in your account settings or by emailing support@flameai.studio. Cancellation stops future charges; you keep paid features and remaining Subscription Credits until the end of the period you have already paid for.
If you upgrade from Plus to Pro mid-period, you are charged a prorated difference for the remainder of the period, a prorated amount of additional Credits is granted on top of your current balance, your renewal date stays the same, and Pro features unlock immediately. If you downgrade from Pro to Plus, the downgrade takes effect at the start of your next billing period; until then you keep Pro features.
Payments are processed by Dodo Payments, which acts as the Merchant of Record (MoR) and reseller of our subscriptions and credits. This means Dodo Payments is the legal seller of the transaction, collects payment from you, and handles tax collection, invoicing, refund processing, and chargeback disputes. The Service itself is provided by FlameAI.
The Payment Processor's Buyer Terms (dodopayments.com/legal/buyer-terms) apply to every purchase. Applicable taxes are collected and remitted by the Payment Processor. We do not store your full payment card details. If a renewal payment fails, we may retry the charge and may suspend or downgrade your account if payment is not received.
Refunds and cancellations are governed by our Refund Policy at flameai.studio/refund-policy, which is part of these Terms.
We may change prices and Credit allocations. Changes to paid subscriptions take effect at your next billing period after at least 30 days' notice. If you do not agree with a change, cancel before it takes effect.
"Your Content" means everything you upload: product photos, prompts, brand assets, and other inputs. You keep ownership of Your Content. You grant us a limited license to host, process, and transmit Your Content solely to operate the Service for you, prevent abuse, and comply with law. We do not use Your Content or your generated output to train AI models.
By uploading, you represent that:
You can delete Your Content at any time; residual copies in backups are removed within approximately 90 days.
Subject to your compliance with these Terms and payment of applicable fees, we assign to you all rights we may hold in the output generated from your requests. You may use it for personal and commercial purposes, including advertising.

We may review content, restrict features, remove content, or suspend or terminate accounts that violate this section, and we may report illegal content to authorities. Report violations to support@flameai.studio.
If you believe content on the Service infringes your copyright, send a notice to support@flameai.studio including: identification of your copyrighted work and the infringing material, your contact information, a good-faith statement that the use is unauthorized, a statement under penalty of perjury that your notice is accurate, and your physical or electronic signature. We respond to valid notices under the U.S. Digital Millennium Copyright Act (17 U.S.C. Section 512), remove infringing material where appropriate, and terminate repeat infringers. Counter-notices may be sent to the same address.
How we handle personal information is described in our Privacy Policy at flameai.studio/privacy, which is part of these Terms.
You can close your account anytime in settings or via support@flameai.studio. We may suspend or terminate your account if you materially breach these Terms (immediately for prohibited content, fraud, security threats, or unlawful conduct), if required by law or by our payment or AI providers, or if we discontinue the Service. If we terminate without cause or discontinue the Service, we will refund the unused portion of prepaid fees pro-rata. On termination, your access ends and we may delete your content and data after a reasonable period. Sections 5-14 survive termination.
THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY OUTPUT WILL BE ACCURATE, FIT FOR YOUR PURPOSE, COMPLIANT WITH PLATFORM POLICIES, OR FREE OF THIRD-PARTY CLAIMS. YOU USE THE SERVICE AND OUTPUT AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $100.
Some jurisdictions do not allow certain exclusions or limitations; in those jurisdictions, the above applies to the maximum extent permitted.
If you use the Service for business purposes, you agree to defend and indemnify us against claims, damages, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of output, or your breach of these Terms or applicable law.
These Terms are governed by the laws of Georgia (the country of our registration), without regard to conflict-of-laws rules. Before filing any claim, you agree to contact us at support@flameai.studio and attempt in good faith to resolve the dispute informally for 30 days. Disputes that cannot be resolved informally will be brought exclusively in the courts of Tbilisi, Georgia.
These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and us regarding the Service. If any provision is unenforceable, the rest remains in effect. We may update these Terms; material changes take effect no earlier than 30 days after notice (by email or in-Service notice), and continued use after the effective date means acceptance. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or corporate restructuring of our business. Our failure to enforce a provision is not a waiver.
